H-1B Quandary
“I have an H-1B visa that will expire next May. At that time I will
have been in the U.S. for six years. If I change employers at that
time, will I be eligible to receive another H-1B visa? Would I be
able to remain in the U.S. while this is pending, even if my H-1B
expires? Does it automatically renew in cases where green card applications

Employment
Green Cards/Where to File
MUST a green card recipient via employment stay with the employer
for good, or at least for a certain period of time? I am in a big
city working for a nice employer who would offer to sponsor me for
a green card, but while I like the job I hate the city and would
prefer to move elsewhere, or even home. What do you suggest?

IN the early 1990s I got a Donnelly visa. I went to the U.S. and worked
for a couple of years. My parents both became sick and I had to go home
to nurse them. They both died within a couple of years. I would love nothing
more than to return to the U.S. where I have many friends and relations.

Dual Citizenship
“MY grandmother was born in Co. Galway. I have her birth certificate
and paperwork that would allow me to apply for an Irish passport. I contacted
my congressional representative about this matter and was told that if
I proceeded with my Irish citizenship application, my U.S. citizenship
would be in jeopardy. Is this true? What would happen if I applied for
Irish citizenship? I would like to, but I don’t want to do anything

Wants to Return
“I HAVE a green card which I was lucky enough to win at the time
of the Morrison visas. I lived in California for a number of years
and loved every minute. I returned to Ireland for family reasons
as my mother was battling cancer and although I was physically able
to return to the U.S., the authorities say I’ve spent too much time

“MY parents are in their mid-sixties. They live in Ireland and are
retired. They are considering buying a holiday home in Georgia or
Florida for many reasons. Is it possible for them to do so, and
is there a special type of visa that they could get after the purchase?

Will We Count?
“I HAVE a query regarding the six-year working visa that would be
granted if the Kennedy/McCain bill is signed into law. We arrived
in New York on May 13, 2005 one day later than the bill’s eligibility
date of May 12. Our fear is that we will not qualify for a visa,

Returning Children
“I AM writing to you from Ireland. My husband and I, together with
our son, aged two, moved back here last year. We had green cards,
and my son was born in the U.S. so he is a citizen. Being a reader
of your column, we applied for and received I-131 re-entry permits
before we moved home, so our green cards are still good. We are
thinking about returning to the U.S., as home hasn’t worked out
exactly the way we planned, and we miss the American way of life.
We have since had another son born here, but we don’t know how we
would get him back to the U.S. Can we just travel in without him
and figure out his status when (if) we go back? Or would I have
to make provisions for him beforehand? I can’t imagine there would
be much fuss about a baby.”

Changing Address
“I HAVE a green card for the past 10 years. I do not want to become
a U.S. citizen as I don’t feel the need, and will probably move
back to Ireland someday. I have heard that people who have green
cards have to report their address to U.S. immigration periodically.
